Welcome to Xnow: Smart Restaurant Suite (“we,” “our,” “us”).
These Terms and Conditions (“Terms”) govern your access and use of the Xnow platform, including its web dashboard, mobile applications, restaurant management tools, and online ordering system (collectively, the “Service”).
By accessing or using Xnow, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Service.
“Platform” refers to the Xnow web dashboard, mobile app, and related services.
“User,” “You,” or “Restaurant” refers to any restaurant owner, staff, or individual using Xnow.
“Customer” refers to end users placing food or table reservations via a restaurant’s Xnow-powered website or app.
“Content” means text, images, data, or other materials uploaded to or generated by the Service.
You must be at least 18 years old and capable of entering into a binding contract to use this Service. By using Xnow, you represent that all information you provide is accurate, current, and complete.
You agree to use Xnow only for lawful business purposes related to restaurant management and customer engagement.
You may not:
Use the Service for fraudulent or illegal activities.
Reverse-engineer, copy, or modify the software.
Share unauthorized access credentials.
Interfere with or disrupt the system, servers, or networks connected to the Service.
To access the full suite of features, restaurants must register for an account.
You are responsible for maintaining the confidentiality of your login credentials and all activity occurring under your account.
We are not responsible for losses resulting from unauthorized access to your account.
Restaurants using Xnow agree to:
Provide accurate menu, pricing, and delivery details.
Fulfill customer orders within the committed timeline.
Handle customer information responsibly and comply with applicable data protection laws.
Ensure content uploaded (e.g., images, descriptions) does not violate intellectual property or privacy rights.
Customers place orders directly through the restaurant’s Xnow-powered website or app.
Payment processing is handled via integrated payment gateways (e.g., Razorpay, Stripe, etc.) as configured by the restaurant.
Xnow is not responsible for disputes between customers and restaurants related to order quality, delivery, or payment failures.
Some Xnow features (such as POS, custom domains, or premium integrations) may require a paid subscription.
Subscription fees are billed as per the chosen plan.
All payments are non-refundable unless required by law.
We reserve the right to change pricing with prior notice.
The platform may integrate with third-party tools like:
Pusher (for real-time notifications)
Twilio (for WhatsApp notifications)
Tawk.to (for live chat)
Google Analytics, Recaptcha, Disqus, Facebook Login, and Pixel
Each third-party service is governed by its own terms and privacy policy. Xnow is not liable for any issues arising from their use.
Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and store your data.
By using the platform, you consent to the processing of your information as described in that policy.
All software, designs, logos, and content within Xnow are the property of TechMasWorld Infotech (OPC) Pvt. Ltd. or its licensors.
You may not reproduce, distribute, or create derivative works without our written consent.
Xnow provides its services “as is” and “as available.”
We make no guarantees that the platform will always be error-free, uninterrupted, or secure.
We are not liable for any:
Data loss, downtime, or technical issues
Financial loss due to restaurant operations or customer disputes
Indirect, incidental, or consequential damages
We may suspend or terminate your access to the Service if you:
Violate these Terms
Engage in fraudulent or abusive activity
Fail to pay for your plan or services
Upon termination, your right to use the Service will immediately cease, and we may delete your data after a retention period.
We may modify these Terms at any time. The updated version will be posted on our website with the effective date.
Continued use of the Service after updates means you accept the new Terms.
These Terms shall be governed and interpreted in accordance with the laws of India, and any disputes shall be subject to the jurisdiction of the courts in Mumbai, Maharashtra.
Xnow: Smart Restaurant Suite is strictly a technology platform provider.
We provide software tools to help restaurants manage their operations but we are not involved in any part of the food preparation, delivery, pricing, hygiene, service, or customer interactions.
Therefore:
We do not cook, prepare, or serve food.
We do not handle delivery logistics or delivery personnel.
We do not verify menu accuracy, pricing, food quality, packaging, or GST details.
We do not participate in customer service, complaints, refunds, cancellations, or disputes between the restaurant and its customers.
All responsibilities related to orders, cancellations, delays, delivery, hygiene, food quality, safety, and customer experience lie solely with the restaurant owner.
We are not responsible for:
Any fraudulent activities committed by restaurants, customers, staff, or third parties using the platform.
Fake orders, chargebacks, identity misuse, or payment fraud.
Misuse of restaurant data, customer data, or admin/staff credentials.
Incorrect information entered by restaurants, including pricing, allergens, discounts, or delivery times.
Misconduct, negligence, or malpractice by restaurant staff or delivery partners.
If any fraudulent or suspicious activity is detected, Xnow reserves the right to:
Suspend or terminate the account
Block access
Report the activity to authorities (if required)
But we hold no legal or financial liability for such incidents.
Xnow, its owners, employees, partners, and affiliates shall not be held legally, financially, or operationally liable for:
Customer disputes with the restaurant
Food poisoning, hygiene issues, or safety complaints
Delivery failures, delays, or missing orders
Refunds, partial refunds, or chargebacks
GST/taxation errors by restaurants
Staff misbehavior, theft, or negligence
Wrong orders, packaging errors, or incorrect billing
Business losses, penalties, or compliance issues faced by restaurants
All responsibility lies completely with the restaurant owner/business using the platform.
Restaurants must comply with all applicable laws including:
FSSAI regulations
Food safety & hygiene standards
GST and taxation laws
Labor and employment laws
Local municipal licensing requirements
E-commerce & consumer protection laws
Xnow does not verify, enforce, or guarantee compliance.
The restaurant is solely responsible for any legal obligations or violations.
You (the restaurant) agree to defend, indemnify, and hold harmless Xnow and its parent company TechMasWorld Infotech (OPC) Pvt. Ltd. from any claims, damages, penalties, losses, legal fees, or liabilities arising out of:
Your business operations
Food quality or hygiene issues
Delivery accidents or negligence
Customer complaints or disputes
Violation of any law or regulation
Misuse of the platform
Fraud, misconduct, or wrongful acts by you or your staff
